97.5 The Fanatic WPEN-FM BRACKET MADNESS CONTEST
These rules apply to 97.5 The Fanatic WPEN Bracket Madness Contest (“Contest”), being conducted locally by Beasley Media Group, Inc. d/b/a WPEN-FM (“Station”). In addition, the General Contest Rules attached hereto and posted at the Station’s website apply to this Contest. If there is a conflict between the General Contest Rules and the Rules for this Contest, the Rules for this Contest shall control.
By entering the Contest, entrants will automatically be entered into the national Second Street Men's College Basketball Tournament contest, which is being administered and conducted solely by Second Street Media Inc. (“Second Street”). Beasley Media Group, Inc. and the Station are not responsible for the execution of the national level contest or for fulfilment of any prizes awarded at the national level. This Contest is not intended to be used for gambling purposes. If it is determined that a participant is using the Contest for gambling purposes, he/she will be disqualified.
1. HOW TO PLAY:
a. The 97.5 The Fanatic WPEN Bracket Madness Contest will begin on Sunday, March 11, 2018] at 5pm Eastern Time (“ET”) and end on Monday, April 2, 2018 at (approximately) 11pm ET.
b. To enter the Contest, entrants must visit www.975TheFanatic.com and follow the links and instructions to enter the “Full Bracket Game” as described below. All entries must be received by the dates and times listed in the descriptions below.
c. Station and Second Street are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God, lost, late, misdirected, postage-due, unintelligible, returned, undelivered entries or email, or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Website, or other connections availability, accessibility or traffic congestion, miscommunications, failed computer, network, telephone, satellite or cable hardware or software or lines, or technical failure, or jumbled, scrambled, delayed or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network. Persons who tamper with or abuse any aspect of this Contest or Website, or act in violation of the Official Rules, or act in any manner to threaten or abuse or harass any person, or violate Website's terms of service, as solely determined by the Sponsor, will be disqualified. Neither Station nor Second Street are responsible for any incorrect or inaccurate information whether caused by Website users, tampering, hacking, or by any of the programming or equipment associated with or used in this Contest, and assumes no responsibility for any errors, omission, deletion, interruption or delay in operation or transmission or communication line failure, theft or destruction or unauthorized Website access. Any use of robotic, macro, automatic, programmed or like methods of play will void all such plays, and may subject that participant to disqualification. Station and/or Second Street reserves the right at its sole discretion, to disqualify any individual (and all of his or her submissions) who tampers with the submission process. Neither Station nor Second Street are responsible for injury or damage to participant's or any other person's computer or property related to or resulting from participating in this Contest.
I. Full Bracket Game
In the "Full Bracket" game, you pick the winner of each game of each round of the tournament prior to the start of the first full round of the tournament (the round of 64 teams) (hereafter referred to as the "First Round").
Select the team that you predict will win each game of the Men's College Basketball Tournament and enter the score for the designated tie-breaker game. You may enter your picks until fifteen (15) minutes before the start of the first game of the First Round of the tournament. You will not be required to pick the winners of the "First Four" play-in games. Limit one (1) entry per person.
Each round of the tournament is worth up to 64 points. There are 6 rounds in the tournament worth up to 384 points. You will receive 2 points for each First Round game you pick correctly. You will receive 4 points for each Second Round game you pick correctly. You will receive 8 points for each Third Round game you pick correctly. You will receive 16 points for each Fourth Round game you pick correctly. You will receive 32 points for each Fifth Round game you pick correctly. You will receive 64 points for picking the winner of the Championship game. If a game is canceled, forfeited, or indefinitely suspended for any reason, that game shall not count for any participant and scores will be computed as if the game did not exist.
The participant with the highest score for each round will be deemed the round winner, subject to verification. The participant with the highest total score for all rounds combined will be deemed the Full Bracket Grand Prize winner, subject to verification of eligibility.
In the event of a tie for the highest score in any round, the winner for the round will be randomly selected from among the tied participants.
In the event of a tie for the highest overall score, the "Score Approximation Formula" outlined below will be used to determine the Grand Prize winner.
Score Approximation Formula:
1. Subtract what the participant chose as the score for the winning team from the actual winning team's score and square this value.
2. Subtract what the participant chose as the score for the losing team from the actual losing team's score and squares this value.
3. Add the value from 1 and 2 above together to get the participant's "score approximation."
The tied participant with the lowest "Score Approximation" will be deemed the winner.
If there are still ties, the ties will be broken based on the following criteria in this order:
4. The most points earned in the Fifth Round.
5. The most points earned in the Fourth Round.
6. The most points earned in the Third Round.
7. The most points earned in the Second Round.
8. The most points earned in the First Round.
9. If there is still a tie, the winner will be randomly selected from the remaining tied players.
d. There will be up to a total of one (1) Prize winner selected in this Station-conducted local Contest.
a. This Contest is open to all Station listeners who are 18 years of age or older as of the date of entry into the Contest, who are legal US residents who reside in Pennsylvania, New Jersey and Delaware except void where prohibited by law. Entrants must possess a valid, government-issued ID. Winner must show proof of residency to verify eligibility.
b. Employees, household members (legally related or not) of employees, and the immediate family members (i.e., spouses, parents, legal-guardians, in-laws, siblings, grandparents, grandchildren and children) of the Station, Second Street and/or any respective parents, subsidiaries, affiliates, directors, officers, governors, owners, advertising, and promotion agencies, agents of any of the preceding entities, participating sponsors/promotional partners, and other radio stations in the Wilmington metro survey area (as defined by Nielsen Audio) are ineligible to participate or win.
c. Contestants are eligible to win a 97.5 The Fanatic WPEN-FM contest only once every thirty (30) days and a prize valued at $600 or more, only once every six months. Only one winner per household (whether related or not) is permitted in any contest.
a. Up to one (1) local Prize will be awarded in the Contest. The Prize consists of five hundred dollars ($500) in the form of a Beasley company check issued in the name of the winner. The Approximate Retail Value of the Prize is $500. Check will be processed and issued within 90 days.
b. Any national prizes awarded will be fulfilled directly by Second Street. The Station is not responsible for any national prizes awarded and fulfilled by Second Street.
c. The Station reserves the right to substitute any prize with another prize of equal or greater value. Prizes are non-transferable and no cash equivalent or substitution of prize is offered, except at the sole discretion of the Station. The Station has not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on a prize (if any) are provided only by the manufacturer, and winners agree to look solely to such manufacturers for any such warranty and/or guarantee. Each winner is responsible for all federal, state and local taxes and may be required to complete an IRS form W-9. Station reserves the right to withhold prizes until completed form W-9 is received.
d. All prizes or prize certificates must be claimed at the office of the Station located at One Bala Plaza, Bala Cynwyd, PA 19005, Monday-Friday between the hours of 9 am – 5 pm. Prize or prize certificate must be claimed within thirty (30) days of winning. Failure to claim prize by the specified time will result in forfeiture of the prize. It is the winner’s sole responsibility to claim the Prize or prize certificate within the timeline provided in these Official Rules.
4. SELECTION OF WINNERS:
a. Up to one (1) local Prize winner will be selected as described above in Section 1 of these Official Rules. Winner will be notified by email or phone.
b. Entrant need not listen to the Station or be present to win.
c. If a winner does not respond within seven (7) days of the initial notification email/call, the prize will be forfeited and awarded to the next highest scoring participant.
d. Decisions of Station management with respect to the Contest are final.

b. The Station reserves the right to end any sweepstakes or amend these rules upon announcement on air and by publication at www.975TheFanatic.com.
d. Copies of the written sweepstakes rules and a list of all winners are available during regular business hours at the main studio of the Station, One Bala Plaza, Bala Cynwyd, PA 19005, or by sending a self-addressed, stamped envelope to the Station.
General Contest Rules
NO PURCHASE OR OTHER CONSIDERATION IS NECESSARY TO PARTICIPATE; PURCHASE DOES NOT INCREASE CHANCES OF WINNING.
Unless otherwise stated in the specific contest rules, entrants must be at least 18 years old and legal residents of the United States, living or working in the Philadelphia metro survey area (as defined by Nielsen Audio). A winner will be disqualified if he/she or a member of his/her household has won a 97.5 THE FANATIC contest with a value over $50.00 within the previous 60 days. Winners will also be disqualified if they or a member of their household have won a GREATER MEDIA PHILADELPHIA (WMMR/97.5 THE FANATIC/WBEN-FM/WPEN) prize or prize package valued at One Thousand Dollars ($1,000.00) or greater in the past 365 days. Employees (including their immediate families and members of the same household) of Greater Media Philadelphia, its affiliates, promotion sponsors, prize providers, advertising and promotional agencies who do business with 97.5 THE FANATIC or any of the promotion sponsors/prize providers, and other radio stations in the Philadelphia metro survey area are not eligible to participate. The term “immediate family” includes spouses, siblings, parents and legal guardians, children and legal wards, grandparents, and grandchildren, including “in-laws.” Unless otherwise stated, there is a limit of one entry per person; multiple entries will disqualify the entrant. Void where prohibited.
Internet Contests and Games:
Game and contest participants using the Internet must provide a valid e-mail address. Limit one entry per e-mail address. All contest entries will become the property of Station and will not be acknowledged or returned.
97.5 THE FANATIC and sponsors not responsible for technical, hardware, software or telephone or other transmission failures of any kind; lost or unavailable network connections; or incomplete, garbled or delayed computer transmissions whether caused by 97.5 THE FANATIC, users, by any equipment or programming utilized in promotions, games or contests, or by human error which may occur in the processing of submissions, which may limit a participant's ability to participate. 97.5 THE FANATIC reserves the right, in its sole discretion, to cancel or suspend a promotion, game or contest should a virus, bug, computer or other problem beyond the control of 97.5 THE FANATIC corrupt the administration, security or proper execution of any Internet promotion, game or contest, or the Internet portion of any 97.5 THE FANATIC promotion, game or contest. 97.5 THE FANATIC, in its sole discretion, may award prizes to entries received by alternate means. All Internet participants agree to be bound by these rules, and the Official General Rules appearing above.
ON-AIR CONTESTS ONLY:
Online listeners to the 97.5 THE FANATIC web stream may experience a reception delay of up to one minute. Listening to the station’s over-the-air broadcast is the best way to participate in this contest.
Winner/caller qualification is subject to FULL phone call completion, and the verification of the caller’s name, address, home phone number, work/cell phone number and social security number, all of which must be provided prior to completion of the call. Contest calls will not be accepted at any other number. If caller gets disconnected for any reason before their name and phone number have been recorded, another call will be taken to determine the winner/qualifier.
If there is any dispute about the identity of an entrant, the registered user of the text message account on the date of entry will be the recognized entrant. All participants acknowledge that messages are distributed by third-party mobile network providers and 97.5 THE FANATIC cannot control certain factors relating to message delivery. Participants acknowledge that, depending on the recipient’s mobile provider service, it may not be possible to transmit the message to the recipient successfully. 97.5 THE FANATIC assumes no responsibility for, and does not guarantee in any way, the availability or performance of any mobile, text or data service, including liability for transmission delays or message failures.
97.5 THE FANATIC does not charge a fee for text entries. It is each entrant’s responsibility to check with their individual carrier and mobile/data plan, as other charges may apply. PLEASE BE ADVISED THAT TEXT MESSAGES SENT TO 97.5 THE FANATIC MAY RESULT IN ONE OR MORE AUTOMATIC BOUNCE BACK MESSAGES, FOR WHICH PARTICIPANTS MAY INCUR A FEE FROM THEIR PROVIDER. 97.5 THE FANATIC assumes no responsibility for charges incurred for text-messaging, including (without limitation) charges resulting from any bounce back messages or contest notices from the Station.
For texting contests in which entrants are asked to text specific information to a designated telephone line at a particular time or times (as announced by 97.5 THE FANATIC): At the time that texts are solicited, the criteria for winning will be announced (for example, first text message received with the correct answer). Only those text messages sent to the specific phone number provided, at the time texting is solicited, will be eligible to win. Texting to the main 97.5 THE FANATIC phone number or any other phone number are not eligible. Winners will be selected in accordance with the criteria announced when text messages are solicited.
For all 97.5 THE FANATIC texting contests, unless otherwise noted, the texter chosen must answer their phone when called or another winner will be selected.
For all texting contests, standard texting charges by your mobile phone carrier may apply; please check your mobile contract for details.
Unless otherwise stated, or where winners are chosen at the Station’s discretion, odds of winning depend on number of eligible entries received. Non-cash prizes are not redeemable for cash. 97.5 THE FANATIC reserves the right, in its sole discretion, to substitute any prize with one of equal or greater value. Winners may not request prize substitution. Prizes are non-transferable and may not be claimed or used by any person other than the winner. Taxes, gratuities and all other incidentals are the sole responsibility of the winner. If the prize is tickets to a performance or event, 97.5 THE FANATIC is not responsible for cancellations due to weather, promoter or performer, and is not obligated to provide an alternate prize.
Unless an earlier date is specified in the rules, all prizes must be claimed within thirty days of the date won or the prize will be forfeited. Office hours are Monday through Friday 9am-5pm, but may close early before holidays. Please call 610-667-8500 to confirm that the office is open before attempting to claim prize. If approved by 97.5 THE FANATIC in advance and subject to completion of all required paperwork, winners may appoint someone to pick up their prize for them. If they do so, that person must present a copy of the prize winner's VALID, GOVERNMENT ISSUED ID or the prize cannot be released. All prizes MUST be picked up at the 97.5 THE FANATIC offices during office business hours unless otherwise noted.
By entering the contest, all participants release and hold harmless the promotion sponsors, 97.5 THE FANATIC, Greater Philadelphia Radio, Inc., and each of their respective parents, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability and any injuries, loss or damage of any kind arising from or in connection with this contest and any prize won. Winners (and their guests, if any) will be required to sign an affidavit and liability/publicity release, releasing 97.5 THE FANATIC and its affiliated companies from all liability in connection with the contest and the award and use of the prize, before claiming the prize.
97.5 THE FANATIC undertakes no liability or responsibility, and makes no warranties, express or implied, with respect to the performance of any prize(s) awarded, for any failure to perform or negligent performance of any service provider, or for any other risk, incident or damage, direct or indirect, relating to or arising out of the contest, including (but not limited to) cancellations, postponements, delays or other scheduling changes; missed events or connections or inability of winner to attend; and accident, injury, death, damage or expense arising from or occurring during the use of the prize, or travel to/from or attendance at any event relating to the contest, by the winner and/or winner’s guest(s). 97.5 THE FANATIC is not responsible for damage to a prize or loss of a prize after the prize has been claimed. Winners must inspect their prizes before leaving the station. 97.5 THE FANATIC is not responsible for technical, hardware or software failure or malfunctions, lost or unavailable network or other telecommunications connections, or lost, late, misdirected, damaged, illegible, inaccurate, incomplete, garbled, disconnected, or delayed contest entries or communications, whether caused by the sender or by any of the equipment or programming associated with or used in this contest, or by any human error which may occur in the execution of the contest. If, for any reason, the contest is not capable of being conducted as planned, including but not limited to infection by computer virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond the control of 97.5 THE FANATIC, station management reserves the right at its sole discretion to cancel, terminate, modify or suspend the contest and/or determine an alternate method of awarding the prize(s).
Entry into any contest constitutes full permission for 97.5 THE FANATIC and promotion sponsors/prize providers and their respective affiliates to broadcast and/or to photograph or publish the participant's name, voice, recorded comments, biographical information, face and likeness, in any medium, without compensation.
If required by applicable law, 97.5 THE FANATIC will report the total value of each prize to the IRS and will furnish winners with a federal Form 1099. Winners must provide their social security number to 97.5 THE FANATIC for tax reporting purposes, and are solely responsible for payment of all taxes incurred as a result of the award of a prize.
Failure to conform to all contest rules, or any fraud or other illegal or inappropriate conduct on the part of a contestant or on a contestant’s behalf, will result in the contestant's disqualification and forfeiture of any prize won. 97.5 THE FANATIC reserves the right to rule ineligible listeners who, in 97.5 THE FANATIC’s sole judgment, engage in abusive conduct with respect to any contest or promotion conducted by 97.5 THE FANATIC or its affiliates. 97.5 THE FANATIC reserves the right to cancel, suspend and/or modify this Contest and these Official Rules at any time, which changes will become effective upon announcement. By taking part in this contest, participants agree to be bound by these rules and all decisions of the judges, who are employees of 97.5 THE FANATIC and whose decisions with respect to all aspects of the contest are final and binding. Copies of written contest rules and, where required by law, the list of winners are available during regular business hours at the 97.5 THE FANATIC studio, One Bala Plaza, Suite 339, Bala Cynwyd, PA 19004, for 60 days after the contest concludes.
As a condition to participating in the Contest, each entrant agrees that any and all disputes that cannot be resolved between the parties, and all causes of action arising out of or in connection with the Contest shall be resolved individually, without resort to any form of class action, exclusively before a court located in Philadelphia, Pennsylvania, having competent jurisdiction, which court shall apply the laws of the Commonwealth of Pennsylvania, without regard to the conflicts of law principles thereof. The entrant and 97.5 THE FANATIC hereby waive any and all right to trial by jury. If any provision of these Rules is declared or found by a court of competent jurisdiction to be illegal, unenforceable or void, then such provision will be null and void but each other provision hereof not so affected will be enforced to the full extent permitted by applicable law.

Beasley Media Group’s Fall 2017 Nationwide Contest

OPEN TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND WASHINGTON, DC, WHO ARE 18 YEARS OF AGE OR OLDER AT TIME OF ENTRY. VOID WHERE PROHIBITED.
- DESCRIPTION: The Beasley Media Group Fall 2017 Nationwide Contest (“Promotion”) begins on Monday, September 18, 2017, and will run through Friday, October 27, 2017. The Promotion is being conducted by Beasley Media Group Inc. and its participating radio stations (the “Stations”) as listed below. The Promotion, known as “The 1K Giveaway” on the Stations, will begin on Monday, September 18, 2017, and will run through Friday, October,27 2017, weekdays between the hours of 5am Pacific Time (“PT”) / 8am Eastern Time (“ET”) and 3:20pm PT / 6:20pm ET (“Promotion Period”).
- ADMINISTRATOR: Beasley Media Group Inc., 3033 Riviera Drive, Suite 200, Naples, FL 34103
- ELIGIBILITY: The Promotion is open only to legal residents of the fifty (50) United States and District of Columbia (U.S.) who are at least eighteen (18) years of age or the age of majority in their state of residence, whichever is older as of date of entry (“Contestant”). Contestants will be competing with listeners from approximately forty six (46) radio stations in multiple radio markets across the United States. Employees, directors and officers and their immediate families (spouses and siblings, parents and children and their spouses) and household members of Beasley Media Group, Hipcricket Corporate and Promotion sponsors (if any), and their respective parent companies, subsidiaries, distributors, affiliates, service providers, advertising and promotion agencies and companies involved in the design, implementation and execution of the Promotion (collectively the “Promotion Entities”), other radio stations in the metropolitan areas of the participating stations and members of their immediate families (parents, children, siblings, spouses) or persons living in the same households as such persons, whether related or not, are not eligible to participate or win. This Promotion is governed by Florida law and is subject to all federal, state and local laws and regulations. Promotion is void in Puerto Rico, and US Territories and jurisdictions (including overseas military installations) and where prohibited. Contestants are required to provide truthful information and Beasley Media will reject and delete any entry that it discovers to be false or fraudulent. Beasley Media will disqualify any entry from individuals who do not meet the eligibility requirements and will also delete any entry as required by law.
- AGREEMENT TO THE OFFICIAL RULES: By participating in the Promotion, each participant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Administrator, which are final and binding in all matters related to the Promotion. Winning the prize is contingent upon fulfilling all requirements set forth herein.
- HOW TO ENTER: There are two (2) ways to enter. Contestants may enter online or via text entry as follows:
- To participate in the Promotion, Beasley Media Group station listeners will need to listen to a participating Station each weekday during the Promotion Period at 8am, 11am, 1pm, 4pm, 6pm eastern time or 5am, 8am, 10am, 1pm, 3pm pacific, when at each time a Cue will be announced. The Cue will include a unique Key Word. Upon hearing the Cue, enter by texting the Key Word to 40772 on a mobile phone or by entering online no later than fifteen (15) minutes after the start of the hour during which the Cue is announced to be entered for a chance to win a $1,000 cash prize.
- On each weekday throughout the Promotion, five (5) potential nationwide prize winners will be randomly selected – (i) one (1) between the hours of 8:00 a.m. ET and 8:15 a.m. ET. (ii) one (1) between the hours of 11:00 a.m. ET and 11:15 a.m. ET. (iii) one (1) between the hours of 1:00 p.m. ET and 1:15 p.m. ET. (iv) one (1) between the hours of 4:00 p.m. ET and 4:15 p.m. ET. (v) one (1) between the hours of 6:00 p.m. ET and 6:15 p.m. ET. A total of one hundred fifty (150) Prizes will be awarded during the Promotion Period. Beasley Media Group participating stations may also announce exact times that future Cues will be played. Station listeners will be entering along with listeners from other stations around the country who will also receive the Key Word announcements at similar times and will be entering before the same Entry Period deadline for each Cue.
- Each entry window shall close at the start of the fifteenth (15th) minute after the top of the hour in which the Cue is announced, regardless of when the Cue airs (each, an “Entry Period”). Each participating station reserves the right to announce the Cue between the first one (1) and fifteen (15) minutes of the hour. Following each Entry Period, Beasley Media will conduct a random drawing from among all mobile phone and online entrants who provided the correct Key Word nationwide during that Entry Period (the “Entry Period Pool”), and one (1) potential nationwide $1,000 cash prize winner will be randomly selected and called by Beasley Media promptly following his/her selection. Only one (1) entry per person, per Cue is permitted regardless of the method of entry. The randomly selected Contestant must be available at the time of Beasley Media’s call to be eligible to win the prize. Once reached by phone, the randomly selected Contestant will be deemed the potential $1,000 cash prize winner (upon confirmation of eligibility). At the time of the call, the potential prize winner will be required to provide all information requested to verify eligibility. Information requested includes their full name, complete address (including zip code), day and evening phone numbers and date of birth. Beasley Media will attempt to call the randomly selected entrant five (5) times shortly following the random drawing for the applicable Entry Period. No voicemail message will be left. If the potential prize winner fails to answer the calls or is disconnected or is otherwise found to be ineligible, the prize will be forfeited and the Station will randomly select another entrant from the same Entry Period Pool to be the potential $1,000 prize winner. This will continue until the $1,000 prize is awarded in that hour (time permitting). By participating in the Promotion entrants consent to Beasley Media contacting them by phone at the telephone number from which the mobile entry was received or as indicated by the entrant on the online entry form. Any and all fees arising out of the transmission of or receipt of a mobile call shall solely be the responsibility of the entrant. Message and data rates may apply per the entrant’s carrier. By participating in the Promotion via mobile entry, entrants acknowledge that text messages are connected and transmitted through third party providers; Beasley Media does not guarantee, and shall not be responsible for, the connection or timeliness of any such text messages.
- To enter via Mobile Phone/Device: To enter by mobile phone, upon hearing the Cue, text the day’s Key Word to 40772 during the Cue’s Entry Period. Message and data rates may apply. Promotion Entities are not responsible for any fees or charges incurred for and associated with mobile entries. The text message entry method is designed to work with most of the major wireless carriers in the United States, but the Promotion Entities make no guarantee that any particular wireless service provider will participate. - To enter via Online Entry: To enter online, upon hearing the Cue visit the Station’s website and follow the links and instructions to enter the Promotion and complete and submit the online entry form during the respective Entry Period following the Cue. By entering online, each entrant consents to receive up to five (5) notification phone calls on their provided phone number if randomly selected as a potential winner. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning an email address or the domain associated with the submitted email address. Multiple participants are not permitted to share the same email address. Online entries submitted may not be acknowledged or returned.
- Entrants may enter only once per Entry Period, regardless of the method of entry (i.e., only one (1) entry per person per Cue). Additional entries will be disqualified by the Promotion Entities solely at their discretion. A listener may only win one $1,000 cash prize during the Promotion, and only one $1,000 cash prize winner per household is permitted during the Promotion Period. For this Promotion only, restrictions that would prevent a listener from winning if he/she had won another recent Beasley Media station contest or promotion will not apply. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Beasley Media. Beasley Media’s computer is the official time keeping device for the Promotion. Any attempt by any Contestant to obtain more than the stated number of entries by using multiple/different identities, registrations or any other methods will void that participant’s entries and that Contestant may be disqualified.
- In the event of an equipment malfunction, Beasley Media reserves the right to award prize to a randomly selected entrant from the immediately prior Entry Period pool, except that any such Contestant who was awarded the prize for such Entry Period will be excluded. Given the volume of participation, Contestants may experience an inability to access website to enter.
- Online listeners to streamed broadcasts may experience a lag in transmissions due to buffering limitations. Entrants should not rely on streamed broadcasts to participate in any contest as they may be disadvantaged when participating in on-air contests. Entrants are encouraged to listen to the Station for the Cues on-air. The Promotion Entities are not responsible for online streaming delays or outages.
- PRIZES: No more than the advertised number of prizes shall be awarded. A prize may not be sold, traded, or commissioned, and is not exchangeable, transferable, or redeemable for cash except in the Promotion Entities’ sole discretion. Prize details and availability are subject to change. There are no substitutions unless specified by Beasley Media and Beasley Media reserves the right to substitute any prize (or prize component) with another prize (or prize component) of equal or greater value at its sole discretion. Prizing may be fulfilled by a third party fulfillment company. The Promotion Entities are not in any way responsible or liable for damages resulting from shipping and handling, loss, use or misuse of any prize awarded in this contest. The prize is awarded if properly claimed according to the Rules and if there are sufficient eligible entries. All other costs and expenses related to prize acceptance and use not specified herein as being provided are the sole responsibility of winner(s). If the winner is disqualified or is found to be ineligible for the contest, Beasley Media reserves the right to determine an alternate winner or not to award the prize, at its sole discretion. Each Prize is $1,000 cash (in the form of a check made payable to the prize winner upon confirmation of his/her eligibility). The Station may award up to one hundred and fifty (150) total Prizes for an approximate total retail value for the Promotion of $150,000. Each cash prize will be issued as a check payable to the order of the prize winner upon verification of eligibility and upon timely receipt of all completed prize winner paperwork. Checks will be processed and mailed within four to eight weeks upon verification of eligibility and receipt of all completed prize winner paperwork. All taxes, including but not limited to, federal, state, and local taxes, and any other costs and expenses associated with the acceptance and use of a prize are solely the responsibility of the winner. The prize winners will each be issued an IRS Form 1099 for the value of their respective prize(s).
- WINNER SELECTION: Potential $1,000 cash prize winners will be determined as described above and will be notified by telephone beginning approximately fifteen (15) minutes following each Entry Period. Listeners from approximately forty six (46) radio stations in multiple radio markets across the United States will be participating at the same time(s). Odds of being selected as a $1,000 cash prize winner depend on the combined number of entries received from all markets. Decisions of Beasley Media with respect to the Promotion are final.
- WINNER NOTIFICATION: Beasley Media may notify potential prize winners by telephone with follow up correspondence by email, U.S. Mail and/or courier. Winners must execute and return any required affidavit of eligibility and/or liability/publicity release within five (5) days of notification attempt or prize will be forfeited. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner forfeits the prize.
- By participating, Contestants agree to: (a) release Promotion Entities, their respective directors, officers, agents and employees (collectively, “Released Parties”) from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of the prize; and (b) except where prohibited by law, consent to the use by Beasley Media, the Station, or any other participating station, or their designees or agents, of winner’s name, hometown, likeness, statements and other personally identifiable information for promotion, advertising and marketing purposes in any media throughout the world without additional consideration and consent or prior review. To the extent not prohibited by law, winners also agree to provide Beasley Media with an interview, which may be used in connection with the Promotion. Promotion Entities are not responsible for incorrect or inaccurate transcription of Entry information, or for any human or other error, late, lost, or misdirected mail, or any other error or malfunction related to or resulting from participation in this Promotion. CAUTION: ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE, TAMPER WITH THE ENTRY PROCESS, OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, PROMOTION ENTITIES RESERVE THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW. Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If for any reason the Promotion is not able to be executed as planned (in whole or in part), due to computer virus, bugs, tampering, unauthorized intervention, fraud, action of entrants, technical failures, or any other causes which in the opinion of Administrator and/or Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Promotion, Administrator and/or Sponsor reserves the right at their sole discretion to disqualify any suspect entry or Contestant and to cancel, terminate, modify or suspend the Promotion. In the event of any cancellation, termination or suspension, notice thereof will be posted at the stations website and/or the event(s) and determination of the prize winner will be made, from among all eligible, non-suspect entries received as of the date of the termination, cancellation or suspension, as Administrator and/or Sponsor determines in their sole discretion. Entries not complying with all rules are subject to disqualification.
- Payments of all federal, state and local taxes are solely the responsibility of the winner. The winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station (or any other commonly owned stations in the Station’s market) in a calendar year with an aggregate value of $600 or more. Failure to submit a completed Form W-9 or equivalent upon request will result in forfeiture of the prize. Such winnings of $600 or more will be reported to the IRS.
- Participation in the Promotion and/or acceptance of prize constitutes entrant’s and/or winner’s agreement to release, discharge, and hold harmless HipCricket Corporation, Beasley Media, the Promotion’s sponsor(s), the participating radio stations, their licensees, and each of their respective parent, subsidiary and affiliated entities, their advertising and promotional agencies, prize suppliers, and participating sponsors, and their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Promotion, including but not limited to any claims based on publicity rights, defamation, or invasion of privacy and prize delivery.
- Beasley Media’s failure to enforce any term of these Official Rules shall not constitute a waiver of this provision. If due to circumstances beyond the control of Beasley Media, including any force majeure event or other event of local or national importance, any segment of the Promotion is delayed, rescheduled, postponed or cancelled, Beasley Media reserves the right, but not the obligation, to cancel, terminate, suspend, or modify the Promotion and shall not be required to award a substitute prize. Further, the Released Parties are not responsible if any part of a Promotion prize that cannot be awarded due to acts of God, acts of war, natural disasters, weather, acts of terrorism, or other factors beyond the Released Parties’ control.
- Contestants understand, acknowledge and agree that the Released Parties shall not be liable for losses or injuries of any kind resulting from the rejection of an entry given Beasley Media’s belief that the contestant was abusing or tampering with the Promotion entry process in any manner or due to any technical malfunction of the telephone or network transmission line or any entries that are late, delayed, garbled, incomplete, misdirected, lost, corrupted or otherwise not in compliance with the rules or applicable law.
- The Released Parties are not responsible for: (i) typographical or other errors in the printing, the offering, or the administration of the Promotion or in the announcement of a prize; (ii) incorrect or inaccurate entry information, human error, failure, or omission; (iii) unauthorized human intervention; (iv) entries not received due to difficulty accessing the internet, service outage or delays, equipment malfunctions, disconnections, or other technological failures, dropped calls or interruptions; (v) misdirected, misdialed, incomplete, incorrect, or late mobile text or website entries; and (vi) any cancellations, delays, diversions, or substitutions or omissions whatsoever by any transportation providers or any other persons or entities providing any services to winner(s) including any results thereof such as changes in services or location necessitated by same.
- Any disputes that may arise hereunder shall be governed in all respects by the laws of the State of Florida without regard to the conflicts of laws principles of any jurisdiction. Venue with respect to any such disputes shall be had in the state and federal courts of the State of Florida.
